The Supreme Court has highlighted that while the law is crucial for protecting women from genuine cases of cruelty and abuse, its misuse can have serious consequences. False accusations can lead to the wrongful arrest of innocent people, family disputes, and considerable emotional and financial stress for those involved.

To address this issue, the Supreme Court has suggested measures such as:

  1. Pre-Arrest Mediation: Encouraging mediation and counseling before proceeding with arrests or legal actions. This can help in resolving disputes amicably and reducing the misuse of the law.
  2. Stringent Guidelines: Implementing stricter guidelines for filing complaints under Section 498A to ensure that they are genuine and not based on frivolous or malicious intentions.
  3. Police Verification: Recommending more thorough investigations by the police before making arrests or taking legal action based on complaints under this section.
  4. Judicial Oversight: Enhancing judicial scrutiny of cases to prevent misuse and ensure that justice is served fairly.

These measures aim to balance the protection of genuine victims of domestic violence while preventing the misuse of the law.
